The Legislative Decree no.387 of December 29, 2003(hereinafter the "Decree") implemented the EC Directive 2001/77 on the promotion of the electricity produced from renewable energy sources in the international electricity market ( hereinafter the "Directive").This piece of legislation represents the basic framework for the renewable energy industry and its purpose is twofold.
On the other hand, it aims at streamlining and cutting down the red tape in administrative proceedings; on the other, it is intended to promote the assessment of the environmental impact of an installation.
Article 12 of the Decree, entitled "Rationalisation and streamlining of authorisation procedures", presents two alternative procedures: the "Sole Authorization", not so different from the ordinary authorization procedure, and a simplified one which requires a mere Notice of Activity Commencement (Denuncia di Inizio Attività aka "DIA").
