Stamp Duty on Life Insurance Policies: New Tax Code for Installment Payments

With Resolution No. 39/E dated 6 June 2025, the Italian Revenue Agency has introduced tax code 2510, to be used by insurance companies when paying stamp duty on communications related to life insurance contracts, calculated for each year up to and including 2024. The first payment deadline is set for 30 June 2025.

This new payment obligation was established under Article 1, paragraph 88, of Law No. 207 of 30 December 2024. In addition, paragraph 87 of the same article provides that, on a going-forward basis, stamp duty under Article 13, paragraph 2-ter of the schedule attached to Presidential Decree No. 642 of 26 October 1972, will be due annually for communications related to life insurance contracts — rather than at the time of policy surrender or reimbursement, as previously required.

It is important to note that for foreign insurance companies operating in Italy under the freedom to provide services regime, the payment of stamp duty remains optional. As such, this new requirement applies only to those companies that have voluntarily opted to pay stamp duty. Choosing to do so relieves Italian policyholders from the obligation to self-assess and pay the IVAFE (tax on the value of financial assets held abroad).

To ease the administrative burden, the legislation allows for the stamp duty amount calculated as of 31 December 2024 to be paid in installments, as follows:

  • 50% by 30 June 2025
  • 20% by 30 June 2026
  • 20% by 30 June 2027
  • 10% by 30 June 2028

Payments must be made via Form F24, using tax code 2510 in the “Erario” (Treasury) section, and specifying 2024 as the reference year.

In case of late payment, the following additional tax codes have been established:

  • 2511 for any applicable penalties
  • 2512 for interest

It is also worth noting that, unlike the previous stamp duty payment procedures (applicable until 2024), which involved official calculation issued by the Italian Revenue Agency based on submitted declarations, the stamp duty due by 30 June 2025 appears to require self-calculated by the insurance companies.
